After more than a year-and-a-half of litigation over 23 cents in disputed overtime, a judge has certified a class action against Office Depot, meaning that the litigation will continue for now. The plaintiff, who worked at the company for six months, claims they failed to include incentive awards when calculating his overtime (which amounted to 19 minutes during his employment). In addition to the 23 cents in back wages, the ex-employee wants $2,000 in “waiting time” penalties.
