Millionaire ex-NBA basketball player David West and his lawyers tried to game the legal system.

West’s $45 million contract with the New Orleans Hornets was almost up when the Deepwater Horizon oil rig exploded in 2010.

Years later, his attorneys thought they could game the system by claiming West qualified for a piece of the settlement, which was set up for people who could prove they earned less after the oil spill happened.

They sued BP for $1.5 million, arguing that West earned less in 2010 than in 2009 and that the New Orleans Hornets were a “tourism industry business” victimized by the spill.

But West’s contract was signed in 2003, and he agreed to be paid more up front than at the end of his contract—meaning the spill had no impact on how much he earned.

Luckily, the appeals court was “on the ball,” and called West’s claim implausible. They tossed this frivolous lawsuit off the court.
