An Illinois woman is tired of being frozen out of the full amount of her icy drink by Starbucks.
Stacy Pincus has filed a $5 million class action lawsuit against the coffee chain alleging they’re ripping off their customers by putting too much ice in their iced coffee.
Pincus claims that paying customers receive half or less of their promised coffee in their Tall (12oz), Grande (16oz), Venti (24oz), or Trenta (30oz) beverage once the Starbucks barista has filled up the cup with ice. The suit accuses Starbucks of breach of express warranty, breach of implied warrant of merchantability, negligent misrepresentation, unjust enrichment, and fraud.
The class is open to anyone who purchased a Starbucks iced beverage in the past 10 years.
Starbucks contends that anyone ordering an iced drink should logically expect the cup to contain ice, and calls this ridiculous lawsuit without merit.
